Ethical conflicts have always been connected with new techniques of reproductive medicine such as in-vitro fertilization. The fundamental question is: When does human life begin and from which stage of development should the embryo be protected? This question cannot be solved by scientific findings only. In prenatal ontogenesis there is no moment during the development from the fertilized oocyte to a human being which could be recognized as an orientation point for all ethical problems connected with the question of the (...) right to dispose of prenatal life (interruption of pregnancy, research on embryos). The protection of an individual human life must be valid for all in the same manner and from the very beginning on. It must not depend on value judgments or on stages of development, so-called grades of humanity, because these would then become selection criteria. Procreated life must have the right to be born. These were the essential ethical arguments which led to the German Embryo Protection Law. (shrink)

Die Medikalisierung des Sterbens hat dazu geführt, dass ein „guter Tod“ zunehmend auch von medizinischen Interventionen erwartet wird. Die Möglichkeiten einer „terminalen Sedierung“ bis zum Tode werden von vielen als Ausweg angesehen, wenn bei unerträglichem Leid und aussichtsloser Prognose der Wunsch nach aktiver Sterbehilfe angesprochen wird. Durch eine Sedierung können zwar bei schwerstkranken Patienten schwerste therapierefraktäre Leidenszustände effektiv gelindert werden. Diese Therapieoption kann aber auch in der Absicht angewendet werden, den Todeseintritt medizinisch zu beschleunigen, so dass im Zusammenhang mit der (...) Euthanasiedebatte auch das Thema der terminalen Sedierung kontrovers diskutiert wird. Richtlinien zu Indikation, Technik und Dokumentation sind notwendig, um Stellenwert und Grenzen der terminalen Sedierung im Rahmen der palliativen Betreuung am Lebensende zu verdeutlichen und durch Transparenz Fehlentwicklungen zu vermeiden. Versuche zur Geschlechtswahl bei der Befruchtung führten in jüngerer Zeit zu anwendbaren, wenngleich noch eingeschränkt erfolgssicheren Techniken. Deren ethische und rechtliche Bewertungen stehen im Mittelpunkt dieser Abhandlung. In Gesellschaften und Kulturen mit traditioneller Bevorzugung männlicher Nachkommenschaft gibt es einerseits ein starkes Interesse für die Geschlechtswahl, andererseits wird in einigen westlichen Ländern der vorgeburtlichen Geschlechtswahl sehr geringe praktische Bedeutung beigemessen. Dabei unterscheidet sich die Verfügbarkeit der entsprechenden reproduktionsmedizinischen Verfahren von freier Zugänglichkeit zu allen Methoden (Präimplantationsdiagnostik, Spermatozoentrennung usw.) des Fortpflanzungsmedizinmarkts (USA) bis (...) hin zu strenger Reglementierung (Deutschland). Es wird anhand der wissenschaftlichen Literatur der Frage nachgegangen, welche für die Begründung rechtlicher Regelung beachtlichen sozialen oder gesundheitlichen Gefährdungen durch präkonzeptionelle Geschlechtswahl verursacht werden könnten, und welche Gründe es andererseits für die Zulässigkeit sozial motivierter präkonzeptioneller Geschlechtswahl gibt. Die bei Krebserkrankungen junger Frauen erforderliche Chemo- bzw. Strahlentherapie kann in der Folge bei den betroffenen Patientinnen zur Unfruchtbarkeit führen. Somit werden die Betroffenen oft gleichzeitig mit einer potentiell lebensbedrohlichen Erkrankung und einem potentiell kinderlosen Leben konfrontiert. Die derzeitigen Methoden zum Erhalt der Fertilität sind experimentell, mit therapeutischer Unsicherheit und gesundheitlichen Risiken belastet, dennoch werden sie zunehmend nachgefragt. Die mit dem Angebot fertilitätserhaltender Maßnahmen verbundene derzeitige Beratungspraxis wird in dem hier vorliegenden Beitrag aus ethischer Perspektive hinterfragt. Ausgehend von einer kritischen (...) Würdigung des nach wie vor häufig angewandten Autonomiekonzepts von Beauchamp und Childress wird diskutiert, auf welche Weise die normative Belastbarkeit der Entscheidungsfindung durch die Vulnerabilität der Patientin limitiert sein kann. Als Alternative zum Autonomiekonzept von Beauchamp und Childress wird anschließend eine Entscheidungsfindung auf der Grundlage biographischer Identität in Anlehnung an das Konzept der personalen Autonomie nach Quante erörtert. Patientenselbstbestimmung und Patientenverfügungen haben zunehmende Bedeutung und Beachtung erfahren. In der vorliegenden qualitativen Studie wurden 15 Patientinnen und Patienten mit amyotropher Lateralsklerose —einer unheilbaren, chronisch-degenerativen Erkrankung mit vorhersehbarer Symptomatik—interviewt, um zu erfahren, welche Werte und Kriterien sie bei prospektiven Entscheidungen am Lebensende und bei der Abfassung von PV zugrunde legen. Die Auswertung erfolgte nach der Methode der „grounded theory“. Die befragten Patientinnen und Patienten befürworteten einen Verzicht auf lebenserhaltende Behandlungen, wenn sie keine hinreichenden Lebensmöglichkeiten mehr sahen, d. h. wenn sie (...) die aktuelle Lebensqualität für unzureichend erachteten und die Chance auf Besserung als gering einschätzten. Dem Patientenwillen sprachen sie bei der Entscheidungsfindung ein Vetorecht zu. Patientenverfügungen fassten sie erst ab, als sie keine Hoffnung mehr auf Besserung ihrer Erkrankung hatten. Sie verstanden diese als Instrumente zur vorsorglichen Erklärung ihres Wunsches, auf lebensverlängernde Maßnahmen zu verzichten, wenn die LM inakzeptabel geworden sind. Damit wollten sie sich gegenüber dem Arzt absichern, den sie in der Rolle eines Anwalts des Lebens sahen und mit dem sie daher ihre Behandlungswünsche nicht besprochen haben. Trotz vorhersehbarer Symptomatik legten sie in ihren PV keine spezifischen Behandlungswünsche nieder, sondern verwendeten allgemeine Formularmuster ohne konkreten Bezug zu ihrer Erkrankung. Daher bestehen auch bei dieser Patientengruppe Zweifel, ob die PV in einer konkreten Behandlungssituation hilfreich sind. (shrink)

The title of this work is a somewhat saucy overstatement of its thesis—that perceivers seek in works of art experiences of "discontinuity" and "disorientation," as a kind of "rehearsal" for "real life" situations in which they must negotiate intellectual tensions, resulting from a disparity between what they expect and what actually happens. Art-perceiving, the author asserts, is a "biological, adaptive" mechanism characteristic of the human organism. Peckham, like most thoughtful readers of art history, is irritated by the preposterous assertions that (...) man's perceptions are a mad, disorderly blizzard of phenomena, and the artist alone can bring "order" to the mess. Of course, it is obvious that neither of these notions is very sensible, but the unfortunate truth about the lay psychology of most criticism is that Dr. Peckham's assertions in this connection will probably be regarded as controversial in many departments of literature and fine arts. The author is at his best when barbedly [[sic]] criticizing his colleagues; he is at less than his best, however, when he assumes the mantle of philosophical psychology in order to bring authority to his arguments. Intent upon finding confirmation in both the fashionable and passe schools of behavioral science and philosophy, he masses gluts of aphorisms from Gestalt psychology, Husserl, Heidegger, Susanne Langer, and Paul Ziff (the last pair being very indiscreetly aligned to form notions which are no less intuitive than those of the various art-historians he is admonishing. In the area of psychology, Peckham ignores all of the current approaches, and in the area of philosophy he refers to linguistic analysis or philosophy of science as though each were substantively and methodologically unified, and possessed clear-cut views about the universe. Drawing on his economics background and his executive experience in the insurance and pension investment industry, as well as supervisory positions on the European Option Exchange, Dr Goslings analyses the securities markets and their structure, and explores their moral strengths and weaknesses in The Netherlands and elsewhere, before offering some practical recommendations.

Hume knew that he was working in the tradition of ‘some late philosophers in England, who have begun to put the science of man on a new footing’—‘Mr Locke, my Lord Shaftsbury, Dr Mandeville, Mr Hutchinson, Dr Butler, &c.’ But there is not much sign in the Treatise or (...) elsewhere in Hume's writings of any close acquaintance with the works of these authors; the presumption must be that he had read them at some time and extracted the main ideas, but was not in the habit of returning to their texts. He had something more important to do, namely to work at philosophical problems of his own. Similarly Kant, though he said that the Critique of Pure Reason was not meant to be ‘a critique of books and systems, but of the faculty of reason in general’, had clearly felt the impact of the thought of some important past philosophers, but equally had never spent much time in finding out just what these philosophers had to say. Plato, Aristotle, Descartes, Locke, Leibniz and Hume all get fairly frequent mention in his pages. But Kant takes his knowledge of Plato and Aristotle from J. J. Brucker's Historia critica philosophiae, a six-volume compilation which first appeared in 1742, or from doubtful sources such as Mendelssohn's doctored translation of the Phaedo, and though he doubtless knew the more recent authors at first hand clearly felt no need to study them in any depth. This was true even of writers to whom he attributed a particular importance, such as Leibniz and Hume. The references to Hume in the Critique and Prolegomena are all disappointingly general, and though the summary of Leibniz's philosophy in the section called ‘The Amphiboly of Concepts of Reflection’ has a certain force, it is not documented with references to Leibnizian texts. Kant knows that there is a difference between the views of the historical Leibniz and those which constituted the ‘Leibnizian-Wolffian system’ of his successors. Pp. 182. DM 24.50) For Fichte scholars this closely argued and well organized study of the foundations of Fichte's Wissenscha/tslehre is simply a must. American philosophers generally, however, will not become Fichte enthusiasts after reading this book. But this is not the fault of the authoress, but of Fichte. The key question which Dr. SchiJssler raises is, What role does realism play in Fichte's transcendental idealism? With this question in mind she examines Fichte's "foundation of the entire theory of science" of 1794-1795 and related matters, and the "theory of science" of 1804, together with the lecture of 1813. As Fichte originally saw the task of philosophy it was to explain theoretical, i.e., scientific, consciousness in terms of its own foundation. In 1804, however, the task was conceived as presentation of absolute truth; and in 1813, Fichte tried to understand the theory of science as a theory of appearances. Dr. Schfissler's thesis is that all three approaches are necessary; that, in fact, the changes in Fichte's conception of what a theory of science is or ought to be are grounded in the nature of transcendental philosophy itself. The book is not something one reads for relaxation; its sustained and detailed arguments militate against that. But it is a highly illuminating study, and well worth the effort of careful analysis. Oxford-Warburg Studies) This is a survey of theories of art of Kant, Schiller, Herbart, Hildebrand, Schopenhauer and Fiedler. One may question the value of a re-statement of this sort, over simply another reading of the works of the authors themselves. Pedro's answer may be found in the Preface and again in a more extended statement in the conclusion. "German aesthetic theory from Kant through to the end of the nineteenth century seemed to contain valuable critical ideas quite absent from contemporary philosophical writing." Pedro's attempt has been to "re-locate notions in current use, like 'aesthetic detachment', within the sustained systematic discourse of which they were once part. This seemed a way both of uncovering a number of assumptions which have been constraining writing on art for some time, and of clarifying a number of crucial insights of earlier theorists." The author's account is almost entirely expository, its negative critical questions being limited almost exclusively to Herbart. Yet even here, when the author indicates that Herbart's theory of mind "exhibits certain very basic logical difficulties," he adds that... (shrink)

Several possibilities are still open to the ethicist concerned with the problem of relativism. We may want to reconsider more carefully than ever before the connotations of "relative," of "action" and of "culture" in the context of those (...) anthropologists whose claims are said to be detrimental to ethics. Of these terms so crucial for what Moser calls relativism of right, only the first has been analyzed from opposite perspectives by Stevenson and Berlin. So far as I know, no one has treated "relative" as a relational term in the fruitful way suggested by Berlin.19 We may also come to realize that the issue of relativism is too much imbedded in historical and metaphysical tenets and thus is not amenable to the ahistorical treatment of the logical status of moral judgment. Thus we may want to rewrite its whole history by exploiting one of the best facets of Moser's essay. That is, a comparative study of the sociology of knowledge with the organic model of cultural anthropology. Lastly we may agree with A. Edel and consider the whole issue a closed chapter in the history of philosophy, and move on to the philosophically more fruitful investigation of the why and wherefore of moral change between generations and between historical periods. L. M. PALMER University of Delaware Ernst Cassirer: Scientific Knowledge and the Concept of Man. By Seymour W. Itzkoff. (Notre Dame, Indiana: University of Notre Dame Press, 1971. Pp. xi +286. $9.95) There is a sense in which the title of this book is misleading. To be sure, Dr. Itzkoff does deal with Cassirer and with Cassirer's neo-Kantian conception of scientific knowledge and of man. But there is more to the book than this. The first seven chapters are, in effect, a demonstration that "Cassirer left us with a difficult theoretical dilemma: the existence of two contrasting and opposed views of human nature" (p. 172). The last two chapters (pp. 172-252) are the author's attempt to bring those two views into harmony within the framework of contemporary science and philosophical analysis. The first two chapters (pp. 1-37) trace briefly the development of philosophical thought from the time of "the intellectual revolution set in motion by Galileo" to Kant's "Copernican revolution"--to the Kantian thesis, that is, that "the fundamental act of perception and the structuring of experience itseLf depend upon... 'transcendental apperception' as a 'condition of the possibility of perception itself'" (p. 27). It is the concern with "form and function" rather than with "substance and reality," which the Marburg neo-Kantians, and with them Cassirer, accepted as the lasting achievement of Kant's "critical philosophy." But Cassirer found in Kant also a "parallel concern... for humanistic disciplines" (p. 33) and, as "a central theme," the assertion of the "autonomy of human nature" (p. 35). The survey is suggestive but, in some respects, it is also inaccurate. For example, Kant's presumed "lapse into a radical subjectivism" cannot be justified by the reference, in passing, as it were, to the Opus postumum (p. 29)--although the fault is here perhaps that of Norman Kemp Smith rather than that of the author. Also, it is hardly accurate to speak of "Kant's postulation of laws of ethical behavior" (p. 36), for, surely, the various formulations of the categorical imperative are not "laws of ethical behavior" but criteria of such laws. Chapters 3 and 4 (pp. 38-98) are devoted to discussions of the nature of scientific knowledge.
